He Spent 5 Months in Jail for a Festival Shooting He Says He Didn’t Do — Now He’s Suing Toledo for $20 Million
TOLEDO, Ohio — Attorneys for Eljay Crisp-Carr, 20, have filed a $20 million federal lawsuit against the City of Toledo and Lucas County, days after prosecutors dropped all charges against him in the June 6 Old West End Festival shooting that wounded 12 people.
Crisp-Carr spent nearly five months in the Lucas County Jail without bond after being accused as one of the gunmen. He faced 56 counts, including 25 counts of attempted murder, 26 counts of felonious assault and a gang charge.
On Friday, Oct. 30, prosecutors asked Common Pleas Judge Lori Olender to dismiss the case, citing “new and developing evidence.” The dismissal was without prejudice, meaning the charges could be refiled. Defense attorney Alex Bodiford has argued Crisp-Carr was not at the festival; the prosecutor’s office said in September it had shared discovery that “may support his defense,” per The Blade.
The Oct. 30 dismissal itself stunned the city: Crisp-Carr told reporters after his release, “I wasn’t even there,” as covered by The Associated Press.
Ka’Nye Taylor, 20, the other man charged as a gunman, remains jailed without bond and is due in court Nov. 9. The investigation remains active.
As of Nov. 1, no lawsuit had been filed — Crisp-Carr’s family had said lawsuits were coming. The Nov. 4 filing is the new development, and it puts the city and county on the hook for a case prosecutors themselves walked away from.
